Terms of Service

By accessing or using Hank AI ("the Service"), operated by ALAMO Artificial Intelligence Labs LLC ("we," "us," "our"), a Texas limited liability company located in Granbury, Texas, you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

Hank AI is an artificial intelligence phone agent that makes and receives phone calls on behalf of users. The Service includes call placement, call recording, transcription, and related AI-powered communication features. Hank AI is available at hank.alamoai.org and via phone at (817) 402-9970.

You must be at least 18 years of age to use the Service. By using Hank AI, you represent and warrant that you are 18 or older and have the legal capacity to enter into these Terms.

All calls placed through or received by Hank AI are recorded and transcribed. By using the Service, you expressly consent to the recording and transcription of all calls. You are solely responsible for informing any third parties on a call that the call is being recorded, in compliance with all applicable federal, state, and local laws, including but not limited to two-party consent jurisdictions.

ALAMO Artificial Intelligence Labs LLC is not liable for any failure by you to obtain required consent from call participants.

The Service is offered under the following plans:

• Day Pass— $10 for 5 calls and 5 audio recordings
• Full Audio— $100/month for 5 calls/day with all audio recordings included
• Unlimited— $200/month for unlimited calls with all audio recordings included

Transcripts are always provided free of charge. Audio recordings require a paid plan. Pricing and features are subject to change without notice. All prices are in United States Dollars (USD) or equivalent in accepted cryptocurrency at the time of transaction.

We accept payment in USDC, XRP, and $HANK token on the XRP Ledger. All cryptocurrency payments are processed on-chain and are non-reversible once confirmed on the respective ledger. You are responsible for sending the correct amount to the correct wallet address.

All sales of digital services are final. Due to the nature of digital services and on-chain cryptocurrency transactions, we do not offer refunds, credits, or exchanges. By purchasing any plan, you acknowledge and agree to this no-refund policy.

You agree not to use Hank AI to:

• Engage in any unlawful, harassing, threatening, or fraudulent activity
• Place calls that violate the Telephone Consumer Protection Act (TCPA), the Telemarketing Sales Rule (TSR), or any applicable telecommunications law
• Impersonate any person or entity
• Interfere with or disrupt the Service or its underlying infrastructure
• Attempt to gain unauthorized access to any systems or data
• Use the Service for robocalling, spam, or unsolicited bulk communications

We reserve the right to suspend or terminate your access at any time, without notice, for violation of these Terms.

All content, branding, software, and technology comprising Hank AI are the property of ALAMO Artificial Intelligence Labs LLC. You are granted a limited, non-exclusive, non-transferable license to use the Service for its intended purpose. You may not copy, modify, distribute, or reverse engineer any part of the Service.

You retain ownership of the content of your calls. By using the Service, you grant ALAMO Artificial Intelligence Labs LLC a limited license to process, store, and transcribe your call content solely to provide the Service. We will not use your call content for training AI models without your explicit, separate consent.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ALAMO ARTIFICIAL INTELLIGENCE LABS LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• YOUR ACCESS TO OR USE OF (OR INABILITY TO USE) THE SERVICE
• ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON OR RELATED TO THE SERVICE
• ANY CONTENT OBTAINED FROM THE SERVICE, INCLUDING TRANSCRIPTION ERRORS OR INACCURACIES
• UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT
• LOSS OF CRYPTOCURRENCY, TOKENS, OR DIGITAL ASSETS, INCLUDING $HANK

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. TRANSCRIPTIONS ARE GENERATED BY AI AND MAY CONTAIN ERRORS.

You agree to indemnify, defend, and hold harmless ALAMO Artificial Intelligence Labs LLC, its officers, members, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or relating to your use of the Service, your violation of these Terms, or your violation of any rights of another party.

We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. Upon termination, your right to use the Service ceases immediately. Any provisions of these Terms that by their nature should survive termination shall survive, including but not limited to the $HANK token disclaimer, limitation of liability, indemnification, and governing law.

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated "Last updated" date. Your continued use of the Service after any changes constitutes acceptance of the updated Terms.

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Hood County, Texas.

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
